Unfair Contract Terms Consultation

The Competition and Markets Authority (CMA) has issued draft guidance on Unfair Contract Terms which is now being consulted on, with the consultation closing on 19 March 2026.

The law on unfair contract terms has not changed since 2015, so businesses’ obligations remain unchanged. But the CMA are updating the guidance to:

  • Make it easier for businesses to understand unfair contract terms law and help them to comply
  • Reflect other relevant developments, including direct consumer enforcement powers for the CMA under the Digital Markets, Competition and Consumer (DMCC) Act 2024.

The CMA is seeking views on the draft guidance, and how they’ve simplified, streamlined and improved its presentation.

The draft guidance intends to improve consumer rights. Members need to review their contract terms and if there is anything in the updated guidance which could cause an issue or be problematic, this needs to be raised in the consultation response.
