The Financial Conduct Authority (FCA) has published a series of documents relating to the legal challenges against its proposed motor finance redress scheme.
The documents include the FCA's statement of case, the statements of case submitted by each of the challengers, together with the Upper Tribunal's directions order and suspension order. The Tribunal has also confirmed that any person wishing to apply to become an interested party in the proceedings must do so by 11.59pm on 4 August 2026.
The FCA has reiterated that firms should continue to comply with the requirements that remain in force under the partial suspension of the scheme. This includes keeping complainants informed about the legal challenge, the expected hearing timetable, the effect of the partial suspension and any impact on the handling of complaints or compensation payments.
To support communications with customers, the FCA has published a consumer factsheet, which firms may use in full, adapt for their own communications or use alongside the wording set out in the FCA's statement.
