The Department for Transport has published its statutory guidance for local authorities outside of London on civil enforcement of bus lane and moving traffic contraventions. Following the BVRLA’s intervention, it includes clarity on how councils should handle representations from vehicle rental and leasing companies.
The guidance states:
“The following are good principles to follow when accepting representations from rental or leasing companies:
- a rental or lease agreement can be for any fixed duration, by agreement of both parties beyond the prescribed 6-month duration
- a statement of liability must be signed by the customer accepting responsibility for penalty charge notices.
The information required other than the statement of liability should be:
- name or company name
- address at the time of hire or lease
- vehicle make and model
- start and end dates of the hiring agreement.”
Twelve councils have already expressed an interest in using these new powers and are likely to start enforcing from late July/August, the association will keep members updated.
