Guidance on Court of Appeal motor finance judgement

The BVRLA’s Leasing Broker inspection programme has been updated to include further questions on commission disclosure and the October Court of Appeal judgement.

The Court of Appeal judgement in October 2024 found in favour of the consumer in three separate cases where individuals had purchased cars through motor dealers acting as credit brokers. Permission has since been granted for the cases to be appealed, with the Supreme Court due to hear them by Easter 2025.

It is important that leasing broker members understand the full detail of the judgement, as well as the implications it could have on their business and the wider industry. The association has compiled a guidance document to help brokers consider the next steps for both the short and long term, and what they need to do to comply with the law.
